Terms of Service — Maple & Gloss Nail Studio

These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, booking channels, website, and related offerings provided by Maple & Gloss Nail Studio (the “Studio”, “we”, “us”, or “our”). By booking an appointment, visiting our premises, purchasing a service, or otherwise using our services, you agree to be bound by these Terms.
1. Introduction and Acceptance of Terms
These Terms form a binding agreement between you and Maple & Gloss Nail Studio, located at 214 Queen Street West, Toronto, ON M5V 2A3, Canada. If you do not agree to these Terms, you must not use our services or make a booking.
You represent that you are at least the age of majority in your province or territory of residence, or that you have the consent of a parent or legal guardian to receive services and enter into this agreement.
2. Scope of Services
Maple & Gloss Nail Studio provides professional nail and hand/foot care services, including but not limited to:
- Classic Manicure
- Spa Pedicure
- Gel Polish Application
- Acrylic Nail Extensions
- Nail Art Design
- Paraffin Hand Treatment
Service descriptions, estimated durations, pricing, and availability may change at any time without prior notice. We may refuse or discontinue services where, in our professional judgment, it is unsafe, inappropriate, or impractical to proceed.
You acknowledge that nail and beauty services may involve inherent risks, including but not limited to minor skin irritation, allergic reactions, nail damage, lifting, breakage, sensitivity to products, and dissatisfaction with aesthetic results. Results may vary based on individual nail condition, health, lifestyle, and aftercare.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information when booking or receiving services.
- Arrive on time for appointments and notify us promptly of any delays.
- Disclose any relevant medical conditions, allergies, skin sensitivities, infections, injuries, pregnancy-related concerns, medications, or other circumstances that may affect service suitability or safety.
- Follow all pre-service and aftercare instructions provided by our staff.
- Maintain respectful conduct toward our staff, other clients, and our premises.
- Refrain from attending appointments if you have symptoms of contagious illness or any condition that may pose a health or safety risk to others.
- Inspect services at the time they are completed and raise any concerns immediately, where reasonably possible.
You are responsible for any loss, damage, or injury caused by your failure to disclose relevant information or by your failure to follow instructions or warnings provided by us.
We reserve the right to refuse service, end an appointment, or require a client to leave the premises if the client is abusive, disruptive, intoxicated, unsafe, or otherwise in breach of these Terms.
4. Payment Terms and Conditions
All prices are listed in Canadian dollars (CAD) unless otherwise stated. Prices may be subject to applicable taxes, including HST, where required by law.
- Payment is due at the time services are rendered unless we agree otherwise in writing.
- We may accept cash, debit, credit card, or other payment methods as made available from time to time.
- Deposits or pre-authorizations may be required for certain services, group bookings, peak periods, or custom nail art appointments.
- You authorize us to charge any applicable deposit, cancellation fee, no-show fee, late fee, or outstanding balance in accordance with these Terms and any booking-specific policies disclosed to you.
- Chargebacks or payment disputes initiated in bad faith may result in suspension of future booking privileges and recovery of reasonable administrative costs to the extent permitted by law.
If a payment method is declined or reversed, you remain responsible for the full amount owed. We may suspend or refuse future services until all outstanding amounts are paid.
5. Cancellation and Refund Policy
We value your time and ours. To help us serve all clients efficiently, the following cancellation policy applies unless a different policy is disclosed at the time of booking:
- Cancellations or rescheduling requests should be made as early as possible and, where feasible, at least 24 hours before the appointment.
- Late cancellations, missed appointments, or no-shows may result in a cancellation fee or forfeiture of any deposit paid.
- Arrivals more than 10 to 15 minutes late may result in shortened service time, rescheduling, or cancellation at our discretion, depending on staff availability and the nature of the service.
Refunds are generally not provided for completed services, except where required by applicable law or where we determine, in our sole discretion, that a refund or re-service is appropriate.
If you are dissatisfied with a service, you must notify us promptly, preferably before leaving the studio, so that we may assess the issue and, where appropriate, offer a correction, adjustment, or other reasonable remedy. We are not responsible for dissatisfaction arising from a change of mind, failure to follow aftercare instructions, or conditions outside our control.
Any approved refund will be processed using the original payment method where practicable and may take a reasonable period to appear, depending on your financial institution.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple & Gloss Nail Studio, its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of enjoyment, loss of profits, or loss of opportunity, arising out of or related to your use of our services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or relating to the services provided shall not exceed the amount paid by you for the specific service giving rise to the claim.
Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for gross negligence, wilful misconduct, or any other liability that cannot lawfully be excluded under applicable Canadian law.
You acknowledge that certain services may not be suitable for all individuals. We do not provide medical diagnosis or treatment. If you have concerns about a skin condition, infection, allergy, or other health issue, you should consult a qualified healthcare professional before receiving services.
7. Intellectual Property Rights
All content created, displayed, or made available by Maple & Gloss Nail Studio, including but not limited to logos, branding, service names, photographs, designs, text, graphics, promotional materials, and website content, is owned by us or used with permission and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from our intellectual property without our prior written consent, except as permitted by law.
If you provide us with photos, reviews, testimonials, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and share such content for business, marketing, and promotional purposes, subject to applicable law and any privacy choices you communicate to us.
8. Data Protection and Privacy
We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
Personal information may include your name, contact details, appointment history, service preferences, payment information, and health-related information you voluntarily disclose for service safety.
We may use personal information to:
- book and manage appointments;
- provide services and customer support;
- process payments and refunds;
- communicate service updates, reminders, and promotions where permitted by law;
- maintain business records and comply with legal obligations;
- protect the safety and security of our clients, staff, and premises.
We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in our privacy practices and as reasonably necessary to provide services and operate our business.
9. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, power outages, labour disputes, government actions, public health emergencies, supply shortages, transportation disruptions, or equipment failures.
In such circumstances, we may reschedule appointments, modify services, or temporarily suspend operations without liability, except as otherwise required by law.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The updated Terms will be effective upon posting or upon the date specified in the revised version.
Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Toronto, Ontario, Canada, unless applicable law requires otherwise.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
The failure of Maple & Gloss Nail Studio to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
By booking or receiving services from Maple & Gloss Nail Studio, you acknowledge that you have read, understood, and agreed to these Terms of Service.
